These terms are the agreement between you and me when you buy Kirton Learning. By paying, you're agreeing to them. If something here doesn't sit right, email me before you pay — lamont@kirtonlearning.com.
Who you're contracting with
Kirton Learning is a program of Our Rose LLC, which operates from Brooklyn, New York. In these terms, "I" and "me" mean Our Rose LLC and Lamont Kirton. "You" means the parent or legal guardian who purchases the service.
What Kirton Learning is
Kirton Learning is supplemental educational coaching. I read the goals already written in your child's IEP, translate them into plain English, and design project-based work — expeditions, weekly lessons, and a written log — that is aligned to those goals.
What Kirton Learning is not. This is the part I want you to read twice, because some services in this space are vague about it and you deserve better than vague.
- Not special education advocacy. I am not a certified special education advocate. I don't represent you at IEP meetings, CSE meetings, mediations, or hearings.
- Not legal advice. I am not an attorney. Nothing I write or say is legal advice, and reading it doesn't create an attorney-client relationship.
- Not diagnosis or evaluation. I don't diagnose anything, evaluate your child, or determine what services or classifications your child qualifies for. Those are decisions for licensed professionals and your child's IEP team.
- Not medical advice or therapy. Kirton Learning is not special education instruction, related services, speech therapy, occupational therapy, counseling, or any clinical service.
- Not a replacement for your school. Your school district is legally required to deliver the services on your child's IEP. Kirton Learning does not deliver, replace, satisfy, or discharge any part of that obligation. If your district isn't delivering, Kirton Learning is not the remedy — a lawyer or a certified advocate is.
Kirton Learning is what happens at your kitchen table. It is in addition to school, never instead of it.
What I deliver
The Blueprint — $349, one time
- Every goal in your child's IEP translated into plain English.
- A 36-week skill map across reading, writing, and math, aligned to those goals.
- The first build expedition, designed around something your child cares about.
- A 30-minute walkthrough call with me.
- Delivered within 5 business days of receiving both your IEP upload and your completed intake form. If I'm going to miss that, I'll tell you before the deadline, not after.
Kirton Learning Family — $149 per month
- Everything in the Blueprint.
- Weekly lessons built on the current expedition, emailed to you.
- The Log — a dated record of completed work.
- A monthly 30-minute call to adjust the plan.
- A new expedition each term.
What I need from you
I can't build the plan without the materials. Specifically: a legible copy of the current IEP, your completed intake form, and a reply when I ask a question about your child. If I'm waiting on you, the 5-business-day clock is paused until I have what I need.
Pricing and payment
- Payments are processed by Stripe. Prices are in US dollars.
- The Blueprint is charged once, at checkout.
- Kirton Learning Family is a recurring monthly subscription, charged on the same day each month until you cancel.
- If a monthly payment fails, I'll email you before anything stops. Service pauses if it stays unpaid; it picks back up when it clears.
- If I ever change the price, existing families keep their current rate for at least 60 days after I tell them, and I'll tell them by email.
Sliding scale
If cost is the only thing standing between your child and this work, email me. There's a sliding scale for Brooklyn families. It's a real offer, not a marketing line, and asking for it costs you nothing and changes nothing about how I treat you.
Refunds
The Blueprint: 14 days, no argument. If it isn't a fit, tell me within 14 days of receiving your Blueprint and I refund the full $349. You keep the Blueprint either way — I'm not going to ask you to un-read something.
Kirton Learning Family: cancel any time and you won't be charged again. I don't prorate a partial month, but you keep full access through the end of the period you already paid for. If you cancel within 48 hours of a renewal charge you didn't mean to make, email me and I'll refund that month.
Refunds go back to the original card, usually in 5 to 10 business days depending on your bank.
Cancellation
Email me, or use the link in your Stripe receipt. No notice period, no cancellation fee, no retention call you have to sit through. On request I'll send you a copy of your child's Blueprint and Log so the work leaves with you.
I may end the arrangement myself if a payment stays unresolved, if I'm asked to do something outside what Kirton Learning is, or in the rare case someone is abusive toward me. If I end it for any reason other than that last one, I refund the unused portion.
Your responsibilities
- You confirm you are the parent or legal guardian of the child, and that you have the right to share their IEP with me.
- You'll give me accurate information. A plan built on wrong information is a wrong plan.
- You supervise your child's participation. Kirton Learning is a plan and a set of materials, not childcare and not supervision.
- The materials I build are for your family's use. Please don't resell them, publish them, or distribute them to other families or organizations.
Who owns what
Your child's IEP and your child's work belong to you. Full stop. I hold a copy only to do the job, under the terms in the privacy policy.
The Blueprint, lessons, and Log I write for your child are yours to keep and use for that child, permanently, including after you cancel. The underlying Kirton Learning method, templates, and curriculum structure remain mine.
I will not use your child's name, photo, work, or story in any marketing, case study, or website without your specific written permission for that specific item. Silence is not permission.
No guarantee of outcomes
I believe in this method and I've watched it work. But I can't and won't promise a test score, a grade level, a reading gain, a behavior change, a diagnosis outcome, or any particular result at an IEP meeting. Children aren't machines and anyone selling you a guaranteed result is selling you something else.
What I do guarantee is the work itself: the deliverables listed above, delivered on the schedule listed above, or your money back.
Limits on liability
To the extent the law allows: Kirton Learning is provided as described here, and I'm not liable for indirect, incidental, or consequential damages — including educational outcomes, decisions made by your school or district, or results at an IEP meeting.
My total liability to you for any claim is capped at the amount you paid me in the 12 months before the claim.
Nothing here limits liability for fraud, willful misconduct, or anything else the law says can't be limited. If you're in a place where some of this isn't enforceable, that part doesn't apply to you and the rest still stands.
Governing law
These terms are governed by the laws of the State of New York. Any dispute goes to the state or federal courts in Kings County, New York. Before that happens, though, email me. Most things are a conversation, not a case.
Changes to these terms
If I change these terms in a way that affects what you get, what you pay, or your refund rights, I'll email active families at least 30 days before it takes effect. Continuing after that means you accept the change; cancelling before it takes effect means you don't, and you owe nothing further.
